Privacy policy

This policy explains how sensea GmbH handles personal data on our website sensea.ai, in our online shop, in our emails and on our social media pages. The sensea app and device have their own privacy policy: sensea app privacy policy.

In short

  • When you browse sensea.ai, we only use the cookies the shop needs to work, unless you agree to more in the cookie banner.
  • When you make a reservation or order, we use your details to process it.
  • We only send you emails after you have confirmed your address, and you can unsubscribe with one click.
  • We do not sell your data.

sensea GmbH is the controller under the EU General Data Protection Regulation (GDPR).

2. Visiting the website

sensea.ai runs on Shopify. When you open a page, your browser sends technical data that Shopify processes to deliver the site and keep it secure: your IP address, browser and device type, operating system, the page you came from, the pages you open and the time of your visit. These server logs are needed to run the site and to defend it against attacks.

Legal basis: Art. 6(1)(f) GDPR, our legitimate interest in a secure, working website.

3. Cookies and your consent

When you first visit, a banner asks which cookies and similar technologies you allow. We use:

  • Necessary: the cart, checkout, your language and currency, security and remembering your cookie choice. These are always on because the shop cannot work without them (§ 25(2) TDDDG, Art. 6(1)(f) GDPR).
  • Analytics: Shopify's own visit statistics, which show us how many people visit and which pages they use, and Microsoft Clarity, which records clicks, scrolling and session replays in which form fields are masked. Only with your consent: Clarity only loads once you allow analytics.
  • Marketing: the Meta pixel and the Meta Conversions API (see section 6). Only with your consent.

Legal basis for analytics and marketing: your consent (§ 25(1) TDDDG, Art. 6(1)(a) GDPR). You can change or withdraw your choice at any time via the cookie settings link at the bottom of every page. Withdrawing does not affect what happened before.

4. Reservations and orders

When you reserve a sensea or place an order, we process your name, email address, billing and delivery address, phone number if you give it, what you ordered, the amount and the payment status. We need these to perform the contract, send you confirmations and handle refunds (Art. 6(1)(b) GDPR).

Payment. Payments are processed by Shopify Payments and, depending on the method you choose, by the respective provider (card networks, Apple Pay, Google Pay, Shop Pay or Klarna). They receive the data needed for the payment and may run fraud checks. We never see or store your full card details. When you pay with Klarna or Shop Pay, their own privacy policies also apply.

Customer account. You can sign in to our shop with your email address and a one-time code we send you; there is no password. We store your email address, addresses and order history so you can see them later. You can have the account deleted at any time by emailing us.

Retention. We keep order and invoice records for as long as German commercial and tax law requires: invoices and booking records for 8 years, business letters for 6 years (§ 147 AO, § 257 HGB).

5. Emails

Launch news. If you sign up for news on sensea.ai, we send you an email asking you to confirm your address. Only once you click the link do you receive emails from us (double opt-in). We record when you signed up and confirmed, and from which page and campaign, so that we can prove your consent. We send these emails with Klaviyo.

What the emails contain. News about sensea, the launch and our offers, for example when reservations open or a launch price ends. If you have made a reservation, we may also send you information related to it.

Reminders about an unfinished reservation. If you have agreed to receive emails from us and start a reservation without finishing it, we may send you up to two reminders, a few hours and one day later.

Measuring emails. Our emails contain links with tracking parameters and may contain a small image that tells us whether an email was opened and which links were clicked. We use this to improve our emails. You can block it by turning off images in your email program.

Unsubscribing. Every email has an unsubscribe link. You can also email hello@sensea.ai. We then stop sending marketing emails but keep your address on a blocklist so we do not write to you again by mistake.

Legal basis: your consent (Art. 6(1)(a) GDPR, § 7(2) No. 2 UWG). Order and reservation confirmations are part of the contract and are sent regardless (Art. 6(1)(b) GDPR).

6. Advertising and measurement

We advertise sensea on Facebook and Instagram. If you have agreed to marketing cookies, the Meta pixel and the Meta Conversions API tell Meta when you view a page, view the product, add it to the cart, start a checkout, complete a reservation or sign up for news. Meta uses this to show our ads to people who are likely to be interested and to tell us how well our ads work. For the Conversions API, our shop sends these events to Meta directly from its servers, together with data Meta can use to match them to an account, such as a hashed email address and your IP address.

The provider is Meta Platforms Ireland Ltd., Merrion Road, Dublin 4, Ireland. For collecting the data and passing it to Meta, we and Meta are joint controllers (Art. 26 GDPR); Meta's Controller Addendum sets out who is responsible for what. Meta's own processing afterwards is covered by Meta's privacy policy.

When you arrive from one of our ads, the link contains campaign parameters (for example utm_campaign). We store these with your sign-up or reservation so that we know which ads work.

7. Contacting us

If you email us or use a contact form, we use what you send to answer you and keep it for as long as needed to deal with your request, and longer only if the law requires it (Art. 6(1)(b) GDPR for questions about a contract, otherwise Art. 6(1)(f) GDPR).

8. Our social media pages

We have pages on Facebook, Instagram and LinkedIn. When you visit them, the platform processes your data under its own privacy policy. For the page statistics that Meta and LinkedIn give us (for example how many people visited and where they come from), we are joint controllers with the platform (Art. 26 GDPR, see judgment C-210/16 of the Court of Justice of the European Union). We only receive anonymous statistics, not individual visitor data. If you write to us on these platforms, we see your profile name and message. To exercise your rights, the most direct route is the platform itself, but you can also contact us. Legal basis: Art. 6(1)(f) GDPR, our legitimate interest in communicating with people interested in sensea.

9. Who processes data for us

Providers who process data on our behalf do so under data processing agreements (Art. 28 GDPR). We do not sell personal data.

10. Transfers outside the EU

Some of these providers are based in the USA or can access data from there. Where a provider is certified under the EU-US Data Privacy Framework, the transfer relies on the European Commission's adequacy decision (Art. 45 GDPR); otherwise we use the European Commission's standard contractual clauses (Art. 46(2)(c) GDPR). Canada is covered by an adequacy decision.

12. Your rights

You have the right to access the data we hold about you (Art. 15 GDPR), to have it corrected (Art. 16) or deleted (Art. 17), to restrict its processing (Art. 18), to receive it in a portable format (Art. 20), and to withdraw your consent at any time (Art. 7(3)).

Right to object. Where we process your data on the basis of our legitimate interest, you can object at any time for reasons arising from your particular situation (Art. 21(1) GDPR). You can object to the use of your data for direct marketing at any time, without giving reasons (Art. 21(2) GDPR).

Email hello@sensea.ai. We reply within one month. You can also complain to a data protection authority. The authority responsible for us is the Landesbeauftragte für Datenschutz und Informationsfreiheit Nordrhein-Westfalen (LDI NRW), Kavalleriestraße 2-4, 40213 Düsseldorf, www.ldi.nrw.de.

Visitors from the United States. We do not sell personal information. Sharing data with Meta for advertising may count as "sharing" for cross-context behavioural advertising under some US state laws; you can opt out by declining marketing cookies, and we honour the Global Privacy Control signal. Depending on your state, you may also have the right to know, access, correct and delete your personal information: email hello@sensea.ai.

13. Children

Our shop is for adults. We do not knowingly collect data from children under 16.

14. Changes

We update this policy when our website or the law changes. The date at the top shows the current version.
